New York mother gives her child a snack, charged with murder

Food allergies are a serious concern for many people living in New York. Triggering these allergies can have devastating consequences. Unfortunately, it is sometimes the case that even when someone is extremely careful, some factors -- such as production and packaging of food -- simply cannot be controlled.

One New York mother discovered this tragedy first hand when she fed her daughter candy that contained traces of peanuts as a reward, which is thought to be the child's cause of death. Now, the mother is facing charges of second-degree murder for her kid's untimely death, which is a willful murder charge. It will be up to a criminal court to sort out the facts.

The death of a child is almost always devastating. Yet, in this particular case, investigators have not yet been able to determine exactly what occurred. The autopsy apparently did not even reveal traces of peanuts in the victim, and the medical examiner has apparently not been able to determine the precise cause of death.

As for now, the only evidence being made public is the mother's attempted suicide and accompanying note she left after she discovered her daughter had died. The mother's note details that she believed the child's death was an accident, and was unaware of the potential peanut content of the candy. Whatever the case, the woman clearly cared for her daughter and had trouble dealing with the grief caused by her death.

While it remains to be seen what the result of this New York murder charge will be, the case appears to underscore the need for the criminal justice system to allow for a full and impartial examination of relevant evidence. The accused woman, understandably distraught over the loss of her child, has every right to mount a vigorous defense aimed at clearing her name and achieving a fair result.
